Our daughter’s “mother” who is a train wreck and hasn’t been in the picture for over 2 year’s. The last time we spoke (2 years ago) she had told me she wanted me to adopt her. My husband is planning on working overseas and god forbid anything happened we want all our duck’s in order. Is there an easy way to get this done? How much are we looking to spend? All help will be appreciated. Were in Texas by the way.

if she agrees to it, it should be pretty straightforward, as you will only need minimal time in court

Assuming you know how to contact her, you can file for adoption, find an attorney in your area who specializes in family law, preferably adoption.


If she is not around at all, you may have problems.


The child’s father if known will come into play


Guardianship may be a better answer for you for the short haul until you can get the adoption worked out.

If she agrees, it’s a simple process. If she doesn’t agree, you’ll have to file papers with the courts and that can take a while and become costly. If your husband has custody of his daughter and you are acting as her mother for all intents and purposes, your husband could give you power of attorney in the event of an emergency. That would, at least, allow you to make medical decisions for her when your husband is away.


If “mom” hasn’t had anything to do with your daughter in over 2 years, you may be looking at abandonment on her part. But, it’s best to consult an attorney on that.
