Request by NOBODY: step daughters social security card and birth certificate have been confiscated by her mother?
My daughters mother insisted on taking her for her drivers learning permit test. We’ve had problems with her mother in the past, but encourage as much “mother/daughter” time as possible. We gave our daughter (16 years of age) her social security card and birth certificate. She never made it to the DMV… but her mother is refusing to return the documents. We can easily get her new documents, but are a bit concerned that her mother “stole” these items from her. Is there any we can get these documents out of her possesion?
I have adopted this child when she was 3. She IS my daughter and my responsibility. Her mother does not have ANY rights to my daughter. NONE. She’s on parole for welfare fraud and by stealing my daughters social security card i fear identity theft. IS THERE NOTHING I CAN DO?

since the person is under 18. the mom did NOT steal these from her, im not say what she did was wrong,
with divorced parents, each parent should have a copy of the child’s birth certificate and SS card, this makes things easier..

Without getting into whatever is going on in the family and all that, this is not your child. You have no legal right to make determinations of any kind unless there is a court order that says so. Of course, her father does have those rights. But don’t get yourself in a legal battle that YOU can’t win. Whatever you do, make sure he handles it. Unfortunately, parents do stuff like this to kids. It’s a power play most of the time. And what nobody really wants is for the Court to get involved. Very seldom does anyone win in that situation. The girl is 16. In two years, none of this will be a legal issue. I suggest you take the high road here and just try to make her get through the two years without having to deal with the battle. Of course, if you feel the child is in any kind of abusive or physical danger from the mom, that’s an entirely different story. But it doesnt sound that way.
EDIT: Good. I’m glad you adopted her. That is not usually the case, so that’s why I raised the issue. The “mother” may be in contempt of court for taking the documents. I would go to probate or family court where the adoption order was granted and make a motion for her to return the documents. I believe the judge will grant that on the grounds that misuse of the documents could cause confusion for the girl. Also, and I don’t mean to alarm you, it would make it easier for her to take the girl under the veil of legitimacy. I think you have more than enough grounds to file this motion and have it granted.
